These conditions are always included and apply to all our offers, order confirmations and all types of agreements between the customer and JM Stugor & Fritid.

Delivery conditions

We manufacture the cabin in connection with orders, we do not have any products in stock, therefore we offer the opportunity to adapt and tailor your product (eg cabin or glass railing) according to your exact wishes. Your item is paid in installments with 30% in connection with the order and approval of the order confirmation, "Instalment 1 of 2 or 3", and 30% before delivery, i.e. after manufacturing "Partial liquidation 2 of 3" before loading on trailer from factory and remaining 40% + shipping within 7 days from delivery, received goods "Final liquidation = Partial liquidation 3 of 3".

If someone is missing or damaged, please let us know as soon as possible so that we have the opportunity to remedy it in the best way possible. If this were to occur, this does not give the customer any right not to make payment, make their own deductions or otherwise not comply with the agreement and terms and conditions entered into. Some of the goods can be delivered separately/at a later date if they are delivered from another supplier but are included in the order, the item(s) will be delivered in close proximity to the cottage but separately. The final payment must be paid in full within 7 days of delivery of the cabin, regardless - this does not give the customer the right to wait for payment.

JM Stugor & Fritid owns the material until full payment is received.

 

We deliver all over the country with, for example, DSV, DB Schenker or another established shipping company at favorable prices. Delivery takes place either to the customer's home, to the specified address (passable road for trucks), with or without on-site unloading, or to the nearest goods terminal where the customer can arrange the collection himself after notification.

ATTENTION! Never book assembly, dates and/or times if you are not 100% sure when the item will be delivered - this must be confirmed in writing as there are several different parties/subcontractors involved in the supply chain, something we cannot fully control. JM Stugor & Fritid disclaims all possible claims or compensation in connection with waiting times. We cannot control deliveries at all levels, for example when a crane truck arrives, their driving and rest times, etc. Therefore, always wait for notification or other information regarding delivery, if possible. 

 

We have shipping agreements with DSV and DB Schenker to try to keep shipping costs as low as possible and that we also try to coordinate shipping in connection with other orders, i.e. the shipping cost is lower because it is spread over the entire load.

 

Guarantee

Satisfied customer guarantee. All products come with a one-year product warranty. Any damages or errors in delivery must be notified to the seller within 15 days at the latest and the errors will be rectified as soon as possible and free of charge.

We will send a new item or replace it. Faulty item is sent back to the manufacturer.
ATTENTION! Errors or damage to goods that are assembled, for example in a cabin, or in another place, are not compensated.

 

JM Stugor & Fritid is responsible for all possible errors or damages discovered in connection with unpacking the cabin. Damaged parts are replaced with new ones free of charge. Mold damage that can occur due to improper storage at the customer's place is not included in the warranty. Should the customer in question discover any inaccuracies for which he himself is responsible, JM Stugor & Fritid shall be as helpful as possible, however, the product/order must be paid for in full, i.e. the final payment has been paid, before appropriate measures can be taken.

JM Stugor & Fritid has no responsibility to remedy the customer free of charge if he has caused the error or otherwise did not follow the conditions for the approval of the product or drawing. If the customer has made payment, regardless of installment #, then he has also accepted our terms.

 

Delivery delay

If delivery delays occur, we will notify you. We will do everything in our power to fulfill your order. There may be occasions that make it impossible to complete the order, for example when our supplier cannot fulfill his commitment to us. 

ATTENTION! We reserve the right to indemnify ourselves from all forms of compensation to the customer, or other types of demands from the customer, regarding delivery delays.

 

The transport risk

We are responsible for the transport risk, i.e. the risk of the goods being damaged or lost during transport from our warehouse to you. JM Stugor & Fritid then replaces the damaged/missing part. You bear the risk in the event of a possible return to us, hence our tip is to send "Recommended" so that everything is in writing, etc.

 

Drawing work (and other help with e.g. building permit documents e.g. situation plan etc.)

Our quotations include plan and facade drawings and simple 3D construction drawing, on a scale of 1:100 (standard), but for other processing, such as customer adaptations, SEK 1,200 per working hour is charged. In the event of an order, if the work and the quote lead to an order, 100% of the amount for this working time is deducted and settled in connection with the final settlement (Part settlement 3 of 3). 

If the customer in question does not place an order, if the work performed and the documents delivered do not lead to an order and delivery of objects, then 100% will be charged. The payment period is 10 days.

The customer owns the right of use to the material that JM Stugor & Fritid supplies, for example as a basis for building permit documents, but it does not include copyright protection, uniqueness or other personal reservation, but JM Stugor & Fritid owns the material that it has produced and delivered to the customer. The customer pays and reimburses JM Stugor & Fritid according to the given rate for access to the material, but is not allowed to sell it on to, for example, a third party. 

 

Tailor-made solutions

We offer changes to existing floor plans at no extra cost. If you change the size of, for example, the building surface, ceiling height, the corresponding square meter price for the extra material is added. We do not stock any products but manufacture to order. In case of possible deductions, selected products that are included in the ordinary material package, a deduction is made of the equivalent of 50% of the new price/value, for example when he opts out of windows and doors, a financial deduction of x kronor is offered. The customer chooses what should be included in the material set, complete or optional parts. Choosing unperforated or perforated, for example an entire wall because you may be unsure about the placement of windows and doors, is fine, but it does not affect the price of the material kit. 

 

Payment

JM Stugor & Fritid reports prices in SEK including VAT (25%). Charges for shipping and possible cash on delivery are added as above. No other taxes or fees are added.

 

Payment must be made to bank giro 702-2866 alternatively to Svenska Handelsbanken (clearnr 6909) account no 984 913 548. When paying from abroad: IBAN: SE79 6000 0000 0009 8491 3548. BIC/National bank id: HANDSESS. Enter the order number/invoice number at the time of payment.

Prices are stated in SEK and 25% VAT. In the event of non-payment, the case is handed over to the Debt Collection Agency and the Swedish Enforcement Agency for collection, as well as a third party/representative in case of disputes. The reference interest rate according to the Interest Act (633/1982). The default interest is 7.0% per year (the reference interest with an addition of seven percentage points according to § 4 of the Interest Act).

 

Reservation of ownership: JM Stugor & Fritid owns the property until full liquidation has been paid.

 

All prices are updated frequently. We reserve the right for any price changes and for incorrect information affected by technical or human error. For products included in various campaigns, the prices apply during the current campaign period when placing the order.

The receipt and order confirmation are sent to your email address in connection with the purchase.

 

ATTENTION! If JM Stugor & Fritid cannot deliver the goods for any reason, according to the agreement, 100% of the customer's possibly paid amount will be refunded or if the customer is not granted a *building permit, then JM Stugor may buy back the cabin for the amount paid excluding possible shipping costs, applies if unopened/ undamaged packaging. Shipping is extra, depending on the delivery address (distance and type of service, e.g. home delivery incl. unloading on site). 

 

In the event of a refund, state the order number, bank, clear number and account number as well as first and last name. Reimbursement normally takes place within 5-10 working days.

 

Complaints & Damaged goods

If the accident were to occur, it is important that you make a correct report. Damage can occur in different ways. If this happens, it still does not give the customer the right not to pay for the goods, to pay the final payment, in accordance with the agreement entered into and the applicable terms and conditions. Late payment interest and a reminder fee will be charged if the customer acts otherwise. We repair and replace damages.
Visible error: Reported directly to the forwarder upon receipt of the item.
Hidden fault: Reported to JM Stugor & Fritid within 8 days of receiving the item or according to a separate written agreement before delivery.

 

JM Stugor is responsible for all possible errors or damages discovered in connection with unpacking the cabin. Damaged parts are replaced with new ones free of charge. Mold damage that can occur due to improper storage at the customer's place is not included in the warranty.

Inventory

It is the customer's responsibility to always take inventory of their kit before starting assembly. 

JM Stugor & Fritid fully disclaims any compensation in the event of downtime for assembly or other types of claims. 

 

Right of withdrawal / Open purchase / Right of exchange / Right of return

JM Stugor & Fritid always writes an order confirmation with the customer, which he approves in writing and accepts the associated conditions, etc. The customer often has plenty of time to read through and accept the order.

One of the conditions is to pay at least 30% in advance in connection with orders because we manufacture the customer's order after order, often tailored precisely to their wishes. We do not stock any products but apply "delivery to order". As a basic rule, consumers have the right to a 14-day right of withdrawal when shopping remotely and outside business premises. We offer a corresponding right of withdrawal or open purchase until the customer's product is manufactured, which is not the same as delivered product. We can be helpful in finding a new buyer if the item has been delivered and the customer regrets it, but we have no obligation to buy the item back, i.e. offer "right of return". The product is often adapted to his particular wishes, etc. In the event of a possible repurchase, the customer is in that case responsible for the necessary handling costs as well as shipping to a new customer and any reduction in value. A prerequisite for this is that the packaging is unbroken, in visible condition and that the item is complete and complete as on delivery.

There is no law that gives the consumer the right to open purchase and/or exchange rights. It is therefore voluntary to offer consumers open purchase and/or exchange rights. The right of withdrawal does not apply to specially adapted products. We often manufacture an item to the consumer's instructions. A custom-made product is given a personal touch with his specific wishes, and then the right of withdrawal does not apply (ch. 2, § 11, p. 3).

What is the difference between right of withdrawal and right of return? The difference is that the right of withdrawal gives the customer the opportunity to return an item that has been used and returned within 14 days from when it was received/delivered.

Customer's "Builder" (property owner) obligations and *Repurchase

Furthermore, it is the customer's responsibility to, for example, apply for a building permit if required and we can be helpful with, for example, required drawings and other documents. The customer thus has a certain duty of investigation.

JM Stugor & Fritid does not require the customer to show any approval for a building permit, but assumes that the customer "Builder" fulfills any requirements and conditions necessary regarding his purchase, for the property and implementation, etc. According to

Deadlines for processing building permits - decisions in matters concerning permits or advance notices are taken within ten weeks, which applies in all municipalities in Sweden. In notification cases, a decision on a start notification must be made within four weeks. More information here: Boverket

 

*Should the customer be refused his building permit if, for example, he has not applied in good time before purchasing the item or for another reason, JM Stugor & Fritid may possibly repurchase the item from the customer up to 10 weeks after the purchase was completed, i.e. The order confirmation was accepted. In that case, the customer must present a copy of the application documents and the rejection of their building permit application from the municipality. The date of purchase of the item appears on the Order Confirmation. The buyback assumes that JM Stugor & Fritid finds a new/different customer who wants to buy the customer's product and accept an Order Confirmation.

 

Force majeure

"Force majeure" is a legal term for overwhelming or uncontrollable forces, natural disasters, pandemics, wars and unexpected or unpredictable events and effects that cannot be dealt with in the usual way, which prevent someone from doing what he intended or committed to, in particular what is up to someone to do according to legally binding agreements.

 

General Data Protection Regulation (GDPR)

GDPR (General Data Protection Regulation), or the data protection regulation, is a law that applies throughout the EU from May 25, 2018. It aims to give us all more control over how information about us is handled and increase the security of how our personal data is processed. JM Stugor & Fritid applies and follows the general regulations regarding this law in all respects, i.e. we protect our customers' personal data from unauthorized persons and ensure that it is not used in an unauthorized manner.
